Purpose of the processing
The data collected will be processed for the purpose of analysing and coordinating the Aeronautical Safety Study (EAS)/Operational Risk Assessment and Mitigation (EARO), as well as to manage and process requests to coordinate UAS flight operations.
The data will be retained for a maximum of 1 year in cases involving the coordination of an EAS/EARO, and 3 years when coordinating UAS flight operations.
Legal basis
The legal basis for ENAIRE to process the personal data is articles 6.1.c and 6.1.e of General Data Protection Regulation 2016/679 of 27 April: compliance with a legal obligation and task carried out in the public interest. And by:
- Royal Decree 517/2024 of 4 June, implementing the legal regime for the civil use of unmanned aircraft systems (UAS).
- Royal Decree 552/2014 of 27 June, which extends air Regulations and common operational provisions for air navigation services and procedures.
Recipients
Your data may be provided to Courts and Tribunals, AENA, the Civil Aviation General Directorate (DGAC), the National Aviation Safety Agency (AESA), law enforcement within the scope of their competencies, and the Independent Administrative Authority for the Technical Investigation of Railway, Maritime, and Civil Aviation Accidents and Incidents when required. Your data is not expected to be transferred internationally.
Rights
Those interested have a right to:
- Be informed if their personal data is being processed by ENAIRE
- Access their personal data, as well as have it deleted.
Request under certain circumstances:
- Data processing restriction, in which case it will only be stored by ENAIRE to exercise or defend claims.
Rights may be exercised through ENAIRE’s Central Data Protection Unit (known as UCPD from its Spanish acronym) - Avda. de Aragón 330 - Edificio B - 28022, Madrid or via the Electronic Office (enaire.sede.gob.es).
In order to handle applicants’ requests to exercise their rights correctly, a recent photograph shall be submitted with the application.
