Purpose of the data processing and storage periods
Voice recordings of the parties involved in air navigation operations to properly manage air traffic, resolve, analyse and monitor incidents, and improve service quality. Laws on databases of public interest maintained by government agencies apply. The data will be stored for 45 days, unless a longer storage period is required to determine potential liabilities under RD. 57/2002 of 18 January, updated by RD. 1180/2018 of 21 September.
Legal basis
The legal basis for ENAIRE to process the personal data is Article 6.1.e of General Data Protection Regulation 2016/679 of 27 April 2016: processing needed for the performance of a task carried out in the public interest. RD. 905/1991 of 14 June, Act 48/1960 of 21 July, on Air Navigation and subsequent amendments, Act 21/2003 of 7 July, on Air Safety (Article 48.a - Section 3), Regulation (EU) No 1139/2018, on common rules in the field of civil aviation, Regulation (EU) No. 448/2014, amending Regulation 1035/2011, regarding the provision of air navigation services, Royal Decree 995/2013, which implements the regulation of the National Operational Safety Programme for Civil Aviation, updated by RD 1088/2020 of 9 December, Regulation (EU) No 376/2014 on the reporting of occurrences in civil aviation, and other applicable national or international regulations.
Recipients
Your data may be provided to the Commission for the Investigation of Civil Aviation Accidents and Incidents (CIAIAC), the State Aviation Safety Agency (AESA), courts, judges, law enforcement, AENA, private air navigation service providers and other relevant authorities. Your data is not expected to be transferred internationally.
Rights
Those interested have a right to:
- Obtain confirmation on if ENAIRE is processing their personal data.
- To consult their personal data, as well as request amendment of inaccurate data, or, where appropriate, request its deletion in the case that, among other reasons, such data is no longer needed for the purposes for which it was collected.
- Request under certain circumstances:
- Data processing restriction, in which case it will only be stored by ENAIRE to exercise or defend claims.
- Data processing objection, in which case ENAIRE will stop data processing, except for compelling legitimate grounds, or to exercise or defend possible claims. Including the processing of their data for automated individual decisions.
