Code of Ethics and Ethics Channel
Code of Ethics
In line with best corporate practice, the Governing Board approved ENAIRE’s Code of Ethics, which sets out the principles and values that must guide the conduct of our professionals, as well as the behavioural standards we are expected to follow in our daily work to ensure our actions reflect those principles and values.
You can view our Code of Ethics at the following link:
Ethics Channel
As part of its commitment to an ethical and compliant culture, ENAIRE has an Ethics Channel through which irregularities can be reported confidentially and securely as a mechanism for their prevention and detection.
This Ethics Channel is part of the Internal Reporting System and meets the requirements of Law 2/2023 on the protection of persons who report regulatory breaches and on the fight against corruption.
Through the Ethics Channel you may report any irregular conduct you become aware of that amounts to a breach of ENAIRE’s Ethical Code, its Compliance Management System or any internal rule on ethics and compliance, as well as:
- events or behaviours that may have criminal implications;
- serious or very serious administrative violations;
- any type of workplace harassment;
- breaches of labour law involving occupational health and safety;
- acts or omissions that may constitute breaches of European Union law under Law 2/2023; or any other irregularity that could give rise to liability for ENAIRE.
You may also raise questions or request guidance in this regard.
The following are considered whistleblowers and may therefore submit reports:
- managerial and executive personnel, and ENAIRE employees, regardless of their functional or hierarchical position, and whether they are current or former employees, or personnel who are in selection or training processes (hereinafter, the "Personnel");
- natural or legal persons who, without being included in the previous paragraph, have obtained information on violations over the course of a professional, administrative, commercial or other relationship with ENAIRE (hereinafter, "Third Parties").
Whistleblowers, whether Personnel or Third Parties, may report any acts or omissions falling within the scope of the system through the various Channels that form part of the Internal Reporting System, or through the official external channels established for this purpose.
The Ethics Channel allows reports to be submitted anonymously. If you choose to provide your details, the information will be handled confidentially and securely.
ENAIRE’s Internal Reporting System is based on the general principles set out in the Policy on the Internal Reporting System and Whistleblower Protection.
You can view the Policy here.
Reports submitted via the Ethics Channel will be handled in accordance with the following principles and safeguards:
- Confidentiality of the whistleblower’s identity and of any third parties mentioned, and of the information provided and its investigation
- Prohibition of retaliation
- respect for the presumption of innocence and the right of defence of the parties concerned
- independence, impartiality and absence of conflicts of interest
- Effective processing of reports
External channels
You may submit a report directly to the Independent Whistleblower Protection Authority (AAI/AIPI), the external authority designated under Law 2/2023 to handle reports outside the organisation’s internal system. You can access it here.
In any case, where the matter may constitute a criminal offence, you may report it directly to the police, the courts or the Public Prosecutor’s Office.
